Legal Agreement

Terms of Service

Please read these terms carefully before using our platform. By accessing Africa Go Trip, you agree to be bound by these professional standards and legal obligations.

Last Updated: March 2024

1. Platform Role & Relationship

Africa Go Trip operates as a Multi-Vendor Marketplace and Online Travel Agency (OTA). Our platform facilitates connections between global travelers ("Clients") and licensed, independent local tour providers ("Operators").

The Contract: When you book an itinerary on Africa Go Trip, the legal contract for the travel service is strictly between you and the Operator. Africa Go Trip acts as an intermediary agent and is not the actual provider of tours, transportation, or accommodation.

2. Bookings, Payments & Escrow

To ensure maximum safety for our travelers, we implement a secure financial protocol:

  • Booking Deposit: A percentage of the total trip cost is required to secure your dates, trekking permits, and lodge reservations.
  • Currency: All transactions are processed in USD unless otherwise specified. Africa Go Trip is not responsible for currency fluctuations or bank fees.
  • Security: Africa Go Trip uses encrypted payment gateways. Your funds are held in a secure trust/escrow account and are only fully released to the operator under the agreed disbursement schedule.

3. Cancellations & Refund Policies

Because safari logistics involve high-cost advance permits (e.g., Gorilla permits or Kilimanjaro fees), the following applies:

Operator-Specific Policies

Each Operator listed on Africa Go Trip has their own cancellation policy, which is clearly displayed on the itinerary page. In the event of a dispute, the Operator's specific policy will prevail.

Non-Refundable Items

Regardless of the cancellation timing, certain costs remain strictly non-refundable including government taxes, park entry permits already purchased, and non-refundable lodge deposits.

4. Traveler Responsibilities

Clients are solely responsible for ensuring they meet all entry requirements for the destination country:

  • Visas & Passports: Ensuring your passport is valid for at least 6 months and obtaining the correct e-visa or entry visa.
  • Health & Vaccinations: Carrying proof of required vaccinations (e.g., Yellow Fever) as per local laws.
  • Travel Insurance: Africa Go Trip mandates that all travelers purchase comprehensive travel insurance covering medical emergencies, evacuation, and trip cancellation.

5. Limitation of Liability

Africa Go Trip and its employees shall not be held liable for any of the following:

Any injury, loss, death, damage, delay, or inconvenience caused by force majeure, including but not limited to: weather conditions, civil unrest, wildlife encounters, mechanical breakdowns, or failures by third-party suppliers (airlines, hotels, etc.).

By booking, you acknowledge that African travel involves an element of personal risk and you voluntarily assume these risks.

6. Operator Conduct & Vetting

While we do not control the daily operations of our vendors, we maintain a Zero Tolerance Policy for the following:

  • Failure to provide the agreed-upon quality of service.
  • Breach of local safety or wildlife conservation laws.
  • Unethical treatment of porters, guides, or local communities.

If an Operator is found in breach of our Luxury Standards, they will be permanently removed from the Africa Go Trip marketplace.

7. Governing Law

These terms are governed by the laws of the jurisdiction in which Africa Go Trip is registered. Any legal disputes arising from the use of the platform shall be resolved in the courts of Arusha, Tanzania, or the primary place of business of Africa Go Trip.
